Renting with mould? Here are your rights
In NSW a rental has to be fit to live in. Serious mould caused by a building fault isn't something you're expected to just put up with.
Step 1: put it in writing
A phone call to the agent doesn't create a record. Email the agent or landlord with dated photos, describe where the mould is and how long it's been there, and ask for repairs in writing. Keep every reply.
Step 2: be clear about the cause
Landlords often blame tenant ventilation. If the mould is coming from a leaking roof, failed waterproofing, rising damp or a plumbing fault, that's a repair obligation — and an independent inspection report is what proves it.
Step 3: escalate properly
- Give a reasonable written deadline for repairs
- Contact NSW Fair Trading for free tenancy advice
- Lodge with NCAT if repairs still aren't done
- Ask your local tenants advice service for support
Keep protecting yourself in the meantime
Ventilate what you can, run a dehumidifier if you have one, and keep a symptom diary if anyone in the house is getting sick. It all supports your case.
